I was just fired and my boss said I owe him money so his kept my 2 checks, Can he?

I work for a BIG company- they have over 300 trucks and spend over 5 grand a week for fuel. My girlfriends uncle installs HHO-Cells ( the ones you see on-line and can buy) Anyway i told him about it and he wanted 2 of them to see how they work. it was on for a day and he said it wasn't working right so I asked if I could check it out-he told me to wait until Monday (its Friday). Monday comes he doesn't come in. Tuesday-the cell is cut,cracked and sitting on the table. Now for the next week and a half he has given me grunt work. Even told me I had to do a roof job for him using my tools and he would supply 2 labors for me but he would only pay me .00 an hour and the labors made more then me. I used to do that sort of work he knew that. I told him no-way! That's crazy he told me to take 3 days off of work then. there's no work! So he wants his money for the cells and I told him to call the Uncle he has all the information. he wouldn't and told me he was keeping my paychecks and then I was fired! I called the Uncle and he has been trying to get my X-boss but they won't put him through. The Cells were paid for by check and made out to the uncle with 2 different #'s to call. I know they X is trying to make the cells himself and thats why he has been giving me grunt work..trying to get me to quit! Can he keep my pay? Oh I did call the labor board and they said I have to wait it out 10 days. I have a bills-10 days????

    no paychecks can be withheld unless you had a contract and had it spelled out about you paying for the cell phone and what it cost to pull out of your check. no contract, no withholding your paychecks.
    the labor board is waiting to see if he will end up paying you before getting involved and that might be the state law requirement for the length of time allowed.
    we are business owners and had a past employee who ran up the cell bill to over $1000 for one month calling overseas to his girlfriend in the army. we fired him before we got the bill because he was drinking on the job. he never returned the uniforms which are very costly.
    our state, as many do, will not allow you to withhold someones pay that they worked for. we were told that we would have to take legal actions against him to make him pay for his cell bill and the uniforms but we would probably lose because we had nothing in writing about either of these issues. so don’t drop this and keep pushing for getting paid, even if you have to wait the 10 days for the labor board to get involved. in the meantime, check online with your state and look up the labor laws yourself about your situation. become knowledgable with the labor laws in your state because some employers cross the line and try to control the situation and treat their employees horrible. makes it look bad for us good law abiding ones that treasure our employees and treat them good.     Your question was way to long to read all of it. No, they cannot legally keep your last two pay checks. File for unemployment immediately because there is a waiting period which doesn’t start until you file.

    Your only recourse is to file a complaint with the Wage and Hour Board at the Dept of Labor. They won’t take the complaint until after your pay day has passed.
